Terms of Use for PDF Files

Kaiyoot Designs – PDF Files

These Terms of Use ("Terms") govern your purchase and use of PDF files sold by Kaiyoot Designs ("we," "us," or "our").

By purchasing, downloading, or using any PDF file, you agree to be bound by these Terms. If you do not agree, do not purchase or use the plan.

1. License Grant

Upon successful purchase and payment, we grant you a limited, non-exclusive, non-transferable, revocable license to use the PDF file solely for your personal, non-commercial use.

You may use the PDF file to build the item for your own personal use only, using materials you purchase separately.

Built items may **not** be sold, resold, rented, donated in bulk, or used for any commercial purpose.

2. Permitted Modifications

You may make small, personal modifications to the design (such as minor scaling or adjustments) solely for building the item for your own personal use.

You may not use any modified version as the basis for a new design or distribute it.

3. Hiring a Professional Builder

You may provide a copy of the PDF file to a carpenter, woodworker, or other professional builder **solely** for the purpose of building the item for your own personal use.

Any professional who receives the file must:

Use it only to build the item for you.
Delete or destroy all copies of the file (including any notes or modifications) immediately after completing the project.
Not keep, reuse, share, or use the file for any other customer, project, or purpose.

You remain fully responsible for ensuring the builder complies with these rules. Any reuse or further use by the builder will be considered a breach by you.

4. Commercial Use or Larger Quantities

If you would like to build multiple items, sell built items, or use the design commercially, please contact us at info@kaiyootdesigns.com to discuss a separate commercial license.

5. Restrictions

You agree not to:

Share, distribute, copy, upload, or transmit the PDF file except as expressly allowed in Section 3.
Use the file or built items for any commercial purpose except as approved in Section 4.
Resell, sublicense, rent, lease, or otherwise transfer the PDF file or any rights to it.
Remove or alter any copyright notices, watermarks, or attribution included in the file.
Reverse engineer or substantially reproduce the file beyond the allowed personal use.

6. Intellectual Property

Kaiyoot Designs retains full ownership and copyright of all PDF files. Unauthorized use constitutes copyright infringement and may result in legal action.

7. Refunds and Access

PDF files are non-refundable once downloaded. We reserve the right to revoke your license if you violate these Terms.

8. No Warranties & Safety Notice

The PDF files are provided "as is" without any warranties. We do not guarantee they are error-free or suitable for your skill level or materials.

Woodworking involves risks. You (and any builder you hire) are solely responsible for the safety of the build, proper tool use, material selection, and compliance with all local building codes and safety regulations in your area.

9. Limitation of Liability

To the fullest extent permitted by Canadian law, Kaiyoot Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including property damage or personal injury. Our total liability shall not exceed the amount you paid for the plan.

10. Termination

Your license terminates automatically upon any breach of these Terms. You must immediately delete or destroy all copies of the file and stop all use.

11. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved exclusively in the courts located in Calgary, Alberta.
